When this video was shot, the court order to stop construction had already been lifted. And asserting that the pavilion has always been a public space is a bit disingenuous--the bar Luna Park has occupied the space in the summer for the past several years.
The plans for Union Square include significantly more playground space and amenities for the farmer's market.
Even when Luna Park was there the front was basically public, and LP didn't make a 5 mil donation to the reconstruction either as it is thought the new vendor has, the point is to keep this deal transparent and democratic, privatization always appears to benefit someone the point is who and for how long? and the court order has NOT been lifted, work on the pavilion is still on hold as of this writing, construction continues on the playground and the asphalt.

I'm just waiting for the day they announce that all of union square is going to become a disneyland theme park. The theme? "Authentic Olde New York".
